Who owns “Who Dat?”

In a report by the AP:

In wake of New Orleans trip to Super Bowl XLIV, some T-shirt makers who were hit with cease-and-desist letters from the NFL demanding that they stop selling shirts with the traditional cheer of New Orleans Saints fans. The chant — “Who dat say dey gonna beat dem Saints” — is often shortened to “Who Dat” on shirts and signs and has been a mainstay at the Superdome since the 1980s. Check out the legal details HERE as this case presents some interesting trademark issues. From another perspective, just seems like everyone wants a piece of the Who Dat Nation nowadays.

An order today from the civil district court of the Parish of Orleans State of Louisina states:

“Considering the historic victory victory of the New Orleans Saints, the Court finds that the trial will not be able to proceed as originally scheduled. The Court takes judicial notice that Saintsmania permeates the City of New Orleans. Many prospective jurors for the Parish of Orleans, several attorneys involved in this litigation and Court personnel plan on traveling to the promise land – the Superbowl in Miami, Florida. The Court recognizes that this pilgrimage enhances the chance of the Who Dat Nation to acquire the long sought after holy Grail -the Vince Lombardi Trophy.”
